1. Acceptance of Terms

NLVL Design provides web design, development, digital, creative, consulting, and related business services. All content on the Site is provided for general information and promotional purposes.

If there is a conflict between these Terms and a signed agreement, invoice, proposal, or checkout terms, the project-specific terms will control for that transaction.

Fees, payment schedules, deposits, delivery timelines, revisions, scope limits, refund terms, and support terms may vary by project or offer and may be stated separately in writing or during checkout.

Unless otherwise stated in a separate written agreement, work may begin only after required approval, payment, deposit, or both are received.

5. Client Materials and Responsibility

If you provide text, images, logos, videos, credentials, files, feedback, product information, or other materials, you represent that you have the legal right to provide them and permit their use for your requested project or inquiry.

You are responsible for the accuracy, legality, and completeness of materials you provide.

6. Intellectual Property

Our Site and Content

The Site and its original design, branding, text, code, graphics, layout, structure, and related content are owned by NLVL Design or used with permission and are protected by applicable intellectual property laws.

Your Materials

You retain ownership of materials you provide to us, subject to any rights needed for us to perform requested services.

Project Deliverables

Unless otherwise agreed in writing, all draft work, concepts, code, graphics, layouts, mockups, and other work product remain our property until the applicable balance has been paid in full. Final ownership and usage rights for deliverables, if any, are governed by the specific agreement, proposal, invoice, or written arrangement for that project.

7. Third-Party Platforms and Tools

Projects or Site features may involve third-party services, such as hosting providers, domain registrars, payment processors, plugins, APIs, social media platforms, analytics tools, or embedded services. We are not responsible for the availability, pricing, policies, functionality, or actions of third-party services.

Your use of third-party services is subject to their own terms and policies.

8. No Guarantee of Specific Results

We aim to provide high-quality work, but we do not guarantee specific business outcomes, search engine rankings, traffic levels, lead volume, sales results, uptime, compatibility with every third-party system, or uninterrupted access.

Timelines and results may depend on factors outside our control, including third-party services, client response times, hosting environments, domain issues, platform changes, and search engine behavior.

9. Disclaimer of Warranties

To the fullest extent permitted by law, the Site and all content and services provided through it are offered “as is” and “as available,” without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, or availability.

10. Limitation of Liability

To the fullest extent permitted by law, NLVL Design, Cody Leffler, and affiliated parties shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including lost profits, lost revenue, lost data, business interruption, or loss of opportunity, arising out of or related to the Site, services, communications, purchases, or these Terms.

To the fullest extent permitted by law, our total liability for any claim arising out of or related to the Site or services shall not exceed the amount you paid us for the specific service giving rise to the claim, or one hundred U.S. dollars (US $100) if no service payment was made.

11. Indemnification

You agree to defend, indemnify, and hold harmless NLVL Design, Cody Leffler, and affiliated parties from and against claims, liabilities, damages, losses, and expenses arising from your use of the Site, your violation of these Terms, your submitted content, or your violation of any law or third-party right.

12. Termination and Restrictions

We may restrict or terminate access to the Site, decline inquiries, refuse service, cancel submissions, or take protective action at any time if we believe use of the Site violates these Terms, threatens security, creates legal risk, or is abusive, fraudulent, or harmful.
